1. Introduction and Acceptance of Terms

Welcome to TicketsResale.com (“the Platform”, “we”, “us”, or “our”).

These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and any transactions you conduct through TicketsResale.com. By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Platform.

2. Definitions

  • “Buyer”: A Registered User who purchases a Ticket or Tickets through the Platform.

  • “GDPR”: The UK General Data Protection Regulation.

  • “Platform”: The TicketsResale.com website and its associated services.

  • “Registered User” / “Member”: An individual who has created an account on the Platform.

  • “Vendor”: A Registered User who lists a Ticket for sale through the Platform.

  • “Ticket”: A ticket for a specific event that is listed for resale on the Platform.

  • “UK Law”: The laws of England and Wales.

  • “Valid Student Email Address”: An email address issued by a recognised UK university or higher education institution (e.g., ending in .ac.uk).

3. Eligibility and Student Verification

3.1. Student-Only Platform
TicketsResale.com is exclusively for current students of recognised universities and higher education institutions in the United Kingdom.

3.2. Registration Requirement
To use the Platform as a Buyer or Vendor, you must register for an account. During registration, you must:
a) Use your Valid Student Email Address.
b) Verify your email address by clicking on a link we send to that address.
c) Provide accurate, current, and complete information about yourself as prompted.

3.3. Ongoing Eligibility
You are responsible for maintaining your eligibility. If you graduate or otherwise cease to be a student, you must cease using the Platform and may close your account. We reserve the right to suspend or terminate accounts if we reasonably believe the user is no longer a student.

3.4. Verification Checks
We may, at our discretion, implement additional verification steps to confirm your student status (e.g., requesting a scanned student ID card). Failure to comply with such a request may result in account suspension or termination.

4. User Accounts and Responsibilities

4.1. Account Security
You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

4.2. Accurate Information
You warrant that all information provided to us is truthful and accurate. You must update your information promptly if it changes.

4.3. Prohibited Conduct
You agree not to:

  • Use the Platform for any illegal or unauthorised purpose.

  • List fraudulent, counterfeit, or invalid Tickets.

  • Engage in scalping or the resale of Tickets for a profit that violates UK consumer law or the terms of the original ticket seller.

  • Harass, abuse, or harm other users.

  • Use bots, crawlers, or other automated means to access the Platform.

  • Transfer your account to any other person.

5. Listing and Selling Tickets

5.1. Vendor’s Obligations
As a Vendor, you warrant that:
a) You legally own the Ticket you are listing.
b) The Ticket is valid for the event.
c) The listing description is accurate and not misleading.
d) The sale of the Ticket complies with the terms and conditions of the original event organiser and ticket seller.

5.2. Pricing
You may set the sale start price for your Ticket. However, you are solely responsible for ensuring that your pricing complies with all applicable UK laws, including regulations concerning price gouging and unfair trading. A bidding proc4ess will then ensue and the winning bidder will purchase the ticket.

5.3. Prohibited Listings
You must not list Tickets for events where resale is explicitly forbidden by the event organiser’s terms and conditions.

6. Buying Tickets

6.1. Buyer’s Obligations
By purchasing a Ticket, you agree to pay the full listed price after the bidding process ends, plus any applicable service fees. All sales are final unless otherwise stated.

6.2. Ticket Validity
We act as an intermediary and do not guarantee the validity of Tickets listed by Vendors. However, we will investigate claims of invalid Tickets and may take action against the Vendor, including suspending and/or banning their account.

7. Financial Transactions and Fees

7.1. Service Fees
The use of our Platform may be subject to a service fee, which will be clearly displayed before you confirm a transaction.

7.2. Payment Processing
All payments are processed by our trusted third-party payment providers (e.g., Stripe, PayPal). We do not store your full credit/debit card details on our servers.

7.3. Resale Price Cap
In line with UK consumer protection law, particularly regarding the resale of tickets, the Platform may enforce a maximum resale price (e.g., face value plus a small percentage to cover fees). It is the Seller’s responsibility to adhere to this cap.

8. Data Protection and Privacy (GDPR Compliance)

8.1. Data Controller
TicketsResale.com is the data controller for the personal information you provide.

8.2. How We Use Your Data
We collect and process your personal data (including your name, student email address, and transaction history) to:

  • Provide and manage your account.

  • Facilitate transactions between Vendors and Sellers.

  • Verify your student status.

  • Send you service-related communications.

  • Send you marketing communications.

  • Comply with legal obligations.

  • Share your contact details with partners and third-party companies or organisations, under UK GDPR law.

Our lawful bases for processing are: contract performance, legal obligation, and legitimate interests.

8.3. Your Data Rights
Under GDPR, you have the right to:

  • Access the personal data we hold about you.

  • Request correction of inaccurate data.

  • Request erasure of your data (“the right to be forgotten”).

  • Object to processing and restrict processing.

  • Data portability.

8.4. Data Sharing
We will only share your personal data with third parties as necessary to operate the Platform (e.g., with payment processors, or with a Buyer/Seller to complete a transaction). We will never sell your data to third parties for marketing purposes.

9. Limitation of Liability

9.1. Platform “As Is”
The Platform is provided on an “as is” and “as available” basis. We do not guarantee that the Platform will be uninterrupted or error-free.

9.2. Our Liability
To the fullest extent permitted by UK law, we exclude all liability for any loss or damage of any kind arising from your use of the Platform, including, but not limited to:

  • Invalid or fraudulent Tickets.

  • Disputes between Buyers and Vendors.

  • Changes or cancellations of events by organisers.

  • Any unauthorised access to or alteration of your data.

Our total liability to you shall not exceed the total fees we have earned from your transactions in the six months preceding the event giving rise to the claim.

10. Termination

We may suspend or terminate your account and access to the Platform at our sole discretion if we believe you have violated these Terms. You may terminate your account at any time by contacting us or using the account closure function on the Platform.

11. Governing Law and Dispute Resolution

11.1. Governing Law
These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of England and Wales.

11.2. Jurisdiction
You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

12. Changes to the Terms

We reserve the right to modify these Terms at any time. We will notify Registered Users of any material changes via email or a prominent notice on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
